So how are legal systems adapting to the virtual spaces, whether that’s, you know, think about meta or whether it’s the metaverse or virtual reality, augmented reality? I know you’ve discussed this a bit and you’re an expert on it, but what are some of the changes that are happening legally in the augmented reality space or the metaverse?”

Yeah, I mean, there’s quite a lot to discuss there. I’ve given quite a few talks on how real-world laws do—or don’t—apply in virtual worlds. One clear example is privacy. In the physical world, you’re entitled to strong constitutional privacy protections in your home.

As people spend more time in virtual environments and invest personally in building their own spaces—sometimes even creating replicas of their real homes—the question becomes: what rights might exist under U.S. law if something goes wrong? For instance, what happens if law enforcement conducts surveillance in a virtual space without a warrant? Or if a private individual enters your virtual home, takes images, tampers with your belongings, or steals something? These scenarios raise genuinely interesting legal issues.

For now, most of this remains hypothetical. Few, if any, legislatures have seriously considered how to apply existing laws to digital spaces where people now spend so much time—spaces that exist entirely outside the physical world.”
